LEGAL ISSUES OF PROTECTING THE RIGHTS OF CITIZENS IN THE REPUBLIC OF KAZAKHSTAN: THE STATUS OF THE HUMAN RIGHTS COMMISSIONER

Abstract

This article examines the fact that, as stated in the Constitution of the Republic of Kazakhstan, the state of Kazakhstan recognizes itself as a democratic, secular, legal and social state, the most important value of which is a person and his life, rights and freedoms. One of the distinctive features of the rule of law is guaranteed individual rights and freedoms, their fundamental nature, and effective mechanisms for their protection. Mechanisms for protecting citizens' rights in the Republic of Kazakhstan are based on constitutional principles and international human rights standards. This system defines the institution of the Human Rights Commissioner (Ombudsman) as an important legal instrument aimed at restoring violated rights and freedoms of citizens. The ombudsman's powers to review complaints, make recommendations, prevent violations, and promote a culture of legality contribute to strengthening the protection of citizens' rights. Overall, strengthening the ombudsman's position is an important condition for ensuring the rule of law and developing the human rights protection system in Kazakhstan.
